The health care reform legislation signed by President Obama in March makes sweeping changes in the U.S. health care system, many of which directly affect employers. Many of the law’s provisions don’t become effective until Jan. 1, 2014, giving staffing firms time to assess their options. But firms should start planning now for implementation. ASA General Council, Ed Lenz, will focus on what the new law will mean for staffing firms. Topics covered in Ed’s presentation will include:

  • How will the “grandfather” rules affect employer health plans?
  • How does the law affect “mini-med” plans?
  • How the new employer tax penalties will apply to staffing firms that have employees receiving government subsidies
  • How to determine whether your employees are eligible for subsidies
  • How new nondiscrimination rules may affect staffing firms’ ability to offer ‘two-tier” health plans with different levels of benefits to their temporary employees and internal staff  
  • New employer notice reporting and reporting requirements, including new W-2 reporting rules effective Jan. 1, 2011
  • Health coverage options available to staffing firms and the factors they should consider in assessing the costs
  • What ASA and its business allies are doing to mitigate the impact of the law on employers of part-time, temporary, and seasonal employees

Ed Lenz is senior vice president for public affairs and general counsel of the American Staffing Association. He is the staffing industry’s chief legal advocate and a leading authority on the legal and public policy aspects of staffing. He has testified before Congress, state legislatures, and regulatory agencies, and written and spoken widely, on industry issues. He is the author of the authoritative reference book on the subject of co-employment published by ASA, now in its sixth edition. Before joining ASA in 1989, Lenz served for seven years as vice president and assistant general counsel of Kelly Services in charge of legislative and regulatory affairs and served as chairman of the ASA legislative committee. Prior to that, he served in government and in private law practice in Washington, D.C.
